 Dutch court orders review of protocols for gambling licenses

 
 The Dutch State Council, the highest administrative court in the Netherlands, has made a landmark ruling by accepting the Kindred Group's appeal and ordering gaming regulator Kansspelautoriteit (KSA) to reassess its licensing protocols, so that they can be compatible with the laws of the European Union.

The renowned online gaming operator Kindred Group attempted to obtain a license for its company Trannel International Limited, but then withdrew as the KSA requirements were impossible to obtain and the procedure was discriminatory against companies that did not yet possess a license.

In 2019, an administrative court in The Hague had upheld the opinion of the Dutch Gaming Authority but the appeal won by the Kindred Group opens a new window for gambling related proceedings, as its argument was based on the necessity of a Common European Framework.

On this decision, Maarten Haijer, Secretary General of the European Gaming and Gambling Association, said: “We welcome the ruling, which ensures that the KSA will need to verify whether its existing procedures for license allocation comply with European Union law. These are basic requirements of the European legal order that the Council of State reconfirms in its ruling. We are looking forward to the assessment of the KSA regarding the transparency and fairness of its current licensing procedure."
