In Spain, the National Commission of Markets and Competition (CNMC) has analyzed the draft Royal Decree regulating gambling, including the introduction of a voluntary system of deposit limits per player applicable to all operators.
This regulation aims to strengthen control over players by establishing unique and joint deposit limits per player for all operators with whom they have gaming accounts.
CNMC's Findings and Recommendations:
Balance and Prevention: CNMC believes the regulation does not unjustifiably restrict competition, as it is based on protecting consumer health and preventing addictive behaviors.
Disincentive to Change Operators: CNMC warns that this measure could discourage players from switching gaming providers, as having multiple accounts would become less beneficial.
Increased Market Concentration: The measure could promote market concentration among gaming operators, potentially jeopardizing the business models of smaller enterprises with fewer players.
Recommendation: CNMC advises ongoing evaluation of the measure to assess its market impact and ensure effectiveness.
CNMC serves in a consultative capacity and may be consulted by various entities and organizations, or act independently as stipulated by Law 3/2013, dated June 4th.
