Brazil's Federal Court Dismisses Spribe's Motion, Affirms Injunction in Favor of Aviator Studio

The Federal Court of Brazil has rejected the Motion for Clarification filed by Spribe in relation to a previous decision of the Court itself. According to the information available, Aviator Studio responded to this motion on August 14, within the established deadline.

In its latest ruling, issued on Thursday, September 3, 2026, the Court confirmed that the precautionary measure remains in force and specified that any attempt to challenge the substance of the original decision must be channeled through the appropriate legal procedure.

Along these lines, Judge Arthur Pinheiro Chaves pointed out that, in order to properly challenge the merits of the resolution, the appellant must resort to the appropriate procedural mechanism.

In this way, Spribe's Motion for Clarification does not introduce any change in the existing decision or alter the effects of the precautionary measure, which remains as it was issued.

The Court left the way open for Spribe to pursue its challenge: the company may seek further review before the Federal Court of Appeals by filing an Interlocutory Motion.

For Aviator Studio, the resolution represents a new advance in the ongoing legal procedure, since it keeps the precautionary measure in force while the case continues to be processed through the corresponding judicial channels.

The company has reiterated its commitment to protect its intellectual property rights and the integrity of its Aviator brand, as well as to continue to defend its interests in court.
