SPECIAL EXCLUSIVE DRAFT RESOLUTION OF THE MECHANISM FOR THE DETECTION OF RISK BEHAVIORS (II)
THE DOCTRINAL TURN: The DGOJ buries the principle of the rational player and redefines the operational obligations of the sector in its explanatory report
The Explanatory Note and the Report of the Draft Resolution published by the Directorate General for the Regulation of Gambling consolidate a historic doctrinal turn in Spain's regulatory policy.
The supporting document certifies the definitive abandonment of the traditional principle that conceived the participant as a strictly rational consumer, guided by the passive assimilation of informative warnings. Instead, the regulator led by Mikel Arana adopts a holistic approach in which the very configuration of the leisure offer, the mechanics of the quotas, the rotation rhythms of the slot machines and the commercial incentives are recognized as determining factors in the modulation of addictive risk.
The technical report exhaustively assesses the economic, organisational and systems impact that the resolution will transfer to authorised operators in Spain. To eradicate any margin of technical discretion and ensure that information flows without distortions, the DGOJ has developed and made available a validation scheme in .xsd format. This technical file establishes the integrity and consistency guidelines under which operators must compulsorily format and structure their databases before injecting them into the analytical engines, standardising the mass capture of transactional data, wallet histories and connection times of each user.
Along with analytical standardisation, the Report details the mandatory operational and regulatory consequences once an account is formally classified as risky. From the moment of categorisation, the operator is legally disqualified from sending commercial communications, marketing campaigns or personalised promotions to said user. In the same way, the platform must restrict access to bonuses and VIP advantages, block the use of potentially harmful payment instruments and immediately activate assisted safe gaming interfaces, offering guided itineraries towards the strict reduction of deposit limits or temporary and definitive self-exclusion from the system.
