The Federal Supreme Court of Brazil is holding today, Tuesday, November 3, starting at 10:00 a.m. in Brasilia, a public hearing on Provisional Measure 1.394/2026, which prohibits the exploitation of fixed-odds bets and contemplates the cancellation of authorizations granted to companies in the sector.

The session, convened by Judge Luiz Fux, takes place within the framework of the Direct Action of Unconstitutionality 8027, presented by the National Association of Games and Lotteries, which requests the suspension of the measure and questions its constitutionality.

The call has been extended to reach 34 participating entities, organizations and associations, after the magistrate accepted new additions requested by the Attorney General's Office of the Union.

Participants include the Ministry of Finance, the Ministry of Health, the Ministry of Justice and Public Security, the Attorney General's Office, the National Confederation of Industry, the National Confederation of Commerce and the main business associations in the betting sector.

Brazilian football will also have a prominent presence, with representatives from clubs such as Flamengo, Corinthians, São Paulo, Fluminense, Botafogo and Cruzeiro, as well as the Brazilian Football Confederation.

The future of licences and investments made by operators is one of the main sticking points. Companies that have entered the regulated market face the possibility that their authorisations will be revoked as a result of the new ban.

The National Association of Games and Lotteries maintains that the measure is contrary to the constitutional framework and requests that the validity of the legislation that regulates betting in Brazil be maintained.

The hearing will allow to know the positions of the Government, operators, sports organizations and entities that defend greater restrictions on gambling.

Each participant will have a ten-minute speaking turn. The session will be publicly broadcast through the official channels of the Federal Supreme Court.

The outcome of this procedure can have important consequences for investments, sports sponsorship contracts and the legal certainty of the Brazilian betting market.

The holding of the hearing does not mean that the court will issue a final ruling today on the constitutionality of the ban.
