BRAZIL | Pernambuco Court Rejects All Spribe's Claims Against NSX in AVIATOR Dispute

A court in the state of Pernambuco, Brazil, has rejected all claims brought by Spribe against NSX, a company linked to the Betnacional brand, in one of the AVIATOR-related court proceedings in the country.
According to the statement, the ruling determines that NSX did not incur in trademark infringement, copyright infringement or unfair competition practices, dismissing the claims made by Spribe.
The decision marks a new chapter in the various legal disputes between the parties regarding the AVIATOR trademark and associated intellectual property rights.
The statement recalls that the decision adopted in Pernambuco comes after other rulings favorable to Aviator Studio in São Paulo, Brazil, where both courts of first instance and appeal rejected the urgent measures requested by Spribe against Aviator Studio and its operations.
These decisions allowed Aviator Studio to continue operating while the broader dispute related to the AVIATOR trademark continues.
The Pernambuco resolution acquires special relevance, according to the statement, because it addresses the substantive claims against NSX, including the allegations of trademark infringement, copyright infringement and unfair competition, all of which were rejected by the court.
