The association HOSTELERÍA DE ESPAÑA has announced that on December 15, it presented a lawsuit against the ministerial order and the agreement of the Interterritorial Council of August 14 before the National Court.

It should be noted that this order approves the declaration of coordinated actions in Public Health to respond to the increase in positive cases of COVID-19.

According to HOSTELERÍA DE ESPAÑA, the objective of the lawsuit is to achieve the nullity of the contested resolutions based, among others, on the lack of justification of the agreed measures.

They also highlight that according to data from the Ministry of Health, the hospitality industry is not the focus of the pandemic, placing the infection rate in hospitality establishments below 2%.

In this regard, the trade body warns about the excessive criminalization of the sector and the restrictive measures that have brought the hospitality industry to an extreme situation, with the possibility of losing one million direct and indirect jobs and currently with more than 365,000 workers with Record of Temporary Employment Regulation (ERTE) and a third of the premises doomed to closure due to the lack of direct aid.

HOSTELERÍA DE ESPAÑA emphasizes that the hospitality sector generated 6.2% of GDP and employed 1.7 million people before the pandemic. In addition, given the seriousness of the health situation, the sector has made a great effort and economic investment to offer safe spaces to citizens, in which the regulations for capacity, disinfection and social distance are respected.

On the other hand, from the ECIJA law firm they highlight that sufficient medical, scientific and legal arguments have been presented to demonstrate that the measures that have been agreed are not effective, nor suitable, nor proportional to the circumstances of each territory.
