European Lotteries (EL) has expressed its satisfaction after learning that the European Parliament has adopted its negotiating position on the Digital Services Act (DSA) with 530 votes in favor, 78 against and 80 abstentions.
The DSA is a future EU regulation with the aim to create a safer digital space that could come into force in 2023. In this regulation the rights of users are protected through rules to tackle illegal products, services, or content online; enhance the accountability and transparency of algorithms; and deal with content moderation.
In this regard, Arjan van 't Veer, Secretary General of EL, has highlighted the commitment of the members to the fight against illegal online gambling and assures that EL considers that the new provisions could be beneficial for this purpose.
Likewise, the members expect that “an improved notice-and-action mechanism, the concept of trusted flaggers and enhanced consumer protection and know-your-business-customer requirements” will be available.
We must remember that after the publication of the proposal by the European Commission in December 2020, the Member States of the Council adopted their general approach last November. I have urged the Council ahead of its meeting to exclude the explicit mention of online gambling and betting services from DSA.
As expressed by EL in a press release, the adjustments introduced by Parliament include a more transparent and informed choice for the recipients of digital services; prohibition of targeting or amplification techniques involving the data of minors for the purpose of displaying ads, as well as targeting individuals based on special categories of data which allow for targeting vulnerable groups.
Likewise, the recipients of digital services and the organizations that represent them should be able to seek redress for any damage resulting from platforms that do not respect their due diligence obligations.
In closing, European Lotteries has confirmed that it will continue to closely monitor and, as appropriate, actively participate in this discussion in the best interest of its members.
