Judge Francesco Gambato Spisani, asks the European Court of Justice to answer two questions: firstly, to establish whether it is compatible with Community law "a legislation that reduces bonuses and remuneration only for a limited and specific category of operators. , or only with regard to gambling operators with arcade machines, and not to all operators in the gambling sector "and secondly if" the introduction of legislation is compatible with the principle of European law for the protection of legitimate expectations that for exclusively economic reasons it has reduced the remuneration agreed in a concession contract during its duration between a company and an administration of the Italian State ".

Ultimately, the decision in front of Strasbourg is important: knowing that a European state can unilaterally cut the remuneration provided for by an agreement it has signed with operators who complied with their licenses and the conditions established in the contest.
