During the Tax Return campaign, incidents related to online gaming may arise that require a specific review. One of the most sensitive situations occurs when a taxpayer detects winnings derived from gaming activity in their fiscal data that they do not recognize as their own.
For these cases, the Action Protocol for Stolen Identity Taxpayers (PACS) exists, a public service designed to guide individuals whose identity has been used by third parties on online gaming platforms.
In the published video, Cecilia Pastor Pons, Deputy Director General for Gaming Inspection of the Directorate General for the Regulation of Gambling (DGOJ), explains clearly how this protocol works, what steps those affected must follow, and what documentation is required to prove identity theft.
The PACS is especially aimed at those who, when consulting their fiscal data during the Tax Return campaign, find information on online gaming activity that they do not recognize, or those who receive a notification from the Tax Agency for undeclared gaming winnings that they do not consider their own.
The procedure allows users to obtain the annual gaming statement, file the corresponding report with the Law Enforcement Agencies, request activity and account closure certificates from the operators, expand the police report with that documentation, and subsequently transfer all the information to the Tax Agency.
The activation of this service is particularly relevant to streamline the response to potential cases of identity theft, prevent tax damages to the affected taxpayer, and facilitate the traceability of actions between the user, operators, police authorities, and the tax administration.
The DGOJ emphasizes the importance of using the protocol correctly and keeping all documentation associated with the case. The goal is to enable affected citizens to properly justify that they have not carried out the gaming activity reflected in their fiscal data.
