The Brazilian Chamber of Deputies approved Bill 442/91 to legalize gaming with 246 votes in favor and 202 against.
The project allows the exploitation of casino, bingo, jogo do bicho and online games. In this regard, it is expected that it will soon pass to the Senate.
Next, we summarize the most outstanding aspects of the text:
- Elimination of sports betting (fixed fee) since the Ministry of Economy is in the final stages of a regulation covered by Law 13,756 of 2018.
- Turf entities will be able to exploit bingo games and video bingo.
- Creation of an inspection fee for the issuance of a license and an Income Tax incidence of 20% on net prizes equal to or greater than R$10,000.
- Cide-Jogos is born, with a rate of 17% for gaming. The calculation will be the gross operating income basis resulting from the activity, with the deduction of the amount received by players and bettors as prizes.
- After deduction of the prizes paid, the operators must allocate 0.68% of the gross income directly to the financing of the training of the athletes. Of this percentage, 0.48% will go to the CBC (Brazilian Committee of Clubs) and 0.2% to the CBCP (Brazilian Committee of Paralympic Clubs).
- Cide-Jogos resources will be used to finance: programs and actions in the area of sports; programs and actions of the National Player Protection Policy; and, animal defense and protection programs and actions.
- They will also be applied in the financing of health programs and actions related to problematic gambling, in the National Fund for Public Security, in the National Fund for Culture, in the National Fund for Children and Adolescents and in the participation funds of states and municipalities.
- Bingo operators will pay a fee of R$20,000 per authorized establishment. Online games will pay R$600,000 per licensed domain. Casinos, R$ 600,000 per licensed establishment, while jogo do bicho will pay a fee of R$ 20,000 per licensed entity.
- The license of the casinos will be through technical bidding and proposed price and the highest offer to obtain the license and with paid capital of R$ 100 million. It will not be possible to license more than one establishment per federal entity to the same economic group and nor more than five to the same economic group in the national territory.
- The limited existence of licenses for integrated casinos is conditioned to the population criteria of 1 license per state up to 15 million inhabitants, 2 licenses when it has between 15 and 25 million inhabitants and 3 licenses in the case of more than 25 million inhabitants.
- The Executive Power may grant the exploitation of casino games in river or maritime vessels in the national territory for up to 10 (ten) establishments.
- For bingos, there is a limit of 1 place for every 150,000 inhabitants per municipality and with paid-in capital of R$ 10 million. It is limited to 400 video bingo machines per establishment and authorizes operation in stadiums with a capacity of more than 15,000 fans. Likewise, tourist entities will be able to explore bingo and video bingo games.
- The jogo do bicho license will be through a bidding process for the largest investment proposal and the largest proposal to obtain the license, with a minimum value equivalent to the paid-in capital, with a paid-in capital of R$ 10 million and a reserve of resources in guarantee of payment. For every 700,000 inhabitants, a license can be granted.
- The exploitation of the game online, through bets in electronic marketing channels, through the Internet, mobile telephony, mobile computing devices or any other authorized digital communication channel, is authorized by means of accreditation before the Ministry of Economy.
- Advertising and commercial promotion for game websites is prohibited.
- The national banned registry is born, a large database aimed at registering players banned from entering gaming environments.
- The exploitation of any type and form of gaming without meeting the requirements of the law will be punished with imprisonment, from four to seven years, and a fine.
