Aiming to enhance oversight, transparency, and consumer protection in Brazil's growing betting and lottery market, the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance launched its new 2025–2026 Regulatory Agenda on Wednesday. Officialized through SPA/MF Ordinance No. 817/2025, the agenda outlines 13 strategic regulatory initiatives, each with a clear timeline for draft publication and public consultation.

Each action listed has an estimated date for the publication of its draft regulation, ranging from the second quarter of 2025 to the third quarter of 2026. Below is a detailed breakdown of the 13 strategic initiatives that will shape the future of the sector:
1. National Platform for Self-Exclusion and Mandatory Exclusion
Expected: Second quarter of 2025
Goal: To create a platform with clear rules for consulting and sharing data of self-excluded individuals and those banned from betting, such as athletes or regulatory officials. This initiative reinforces responsible gambling and ensures compliance with Law No. 14,790/2023.
2. Improvements in Compensation for Use of Sports Image Rights
Expected: Second quarter of 2025
Goal: To optimize the compensation model through which betting operators remunerate the use of names, nicknames, anthems, and symbols of athletes and sports organizations, in accordance with Law No. 13,756/2018.
3. Creation of a Distinctive Seal for Authorized Operators
Expected: Second quarter of 2025
Goal: To design a tokenized exclusive seal to distinguish regulated betting operators from those in the irregular market. This measure aims to increase consumer trust and promote legal compliance.
4. Modernization of Commercial Promotion Regulations
Expected: Third quarter of 2025
Goal: To update procedures for authorizing, monitoring, and supervising commercial promotions. It includes reviewing Ordinance SEAE/ME No. 7,638/2022 and Decree No. 70,951/1972 to reduce bureaucracy and improve the SCPC (Commercial Promotion Control System).
5. Review of the Instant Lottery Model (LOTEX)
Expected: Third quarter of 2025
Goal: To evaluate and modernize LOTEX operations in line with Laws No. 13,155/2015 and No. 13,262/2016 and Decree No. 9,327/2018, adjusting the model to current market dynamics.
6. Regulation of the Full Supply Chain in the Betting Ecosystem
Expected: Third quarter of 2025
Goal: To regulate online game providers, aggregators, platforms, live studios, and odds providers. The initiative will establish rules for licensing, monitoring, and potential termination of non-compliant services.
7. Establishment of the National Betting System
Expected: Fourth quarter of 2025
Goal: To create a national system that aligns technical and regulatory standards between federal, state, and district governments. It will include topics such as responsible gambling, technical requirements, security, and anti-money laundering efforts.
8. Support for Bettors with Gambling Problems
Expected: Fourth quarter of 2025
Goal: To develop specific guidelines requiring operators to properly support bettors and their families who face addiction or gambling-related disorders. The project aims to tailor customer service models to the specific needs of the betting sector.
9. Review and Improvement of Supervisory Processes
Expected: First quarter of 2026
Goal: To strengthen oversight of authorized operators and combat illegal platforms with enhanced digital inspection and monitoring tools.
10. Review of the Authorization Procedure for Operators
Expected: First quarter of 2026
Goal: To revise the authorization process (Ordinance SPA/MF No. 827/2024), incorporating lessons learned from the first regulatory cycle to make it more efficient and user-friendly.
11. Review of Certification Entity Requirements
Expected: Second quarter of 2026
Goal: To revise Ordinance SPA/MF No. 300/2024 to improve recognition procedures for certification entities of systems, games, and studios. The review will consider the need for physical offices and dedicated teams in Brazil.
12. Modernization of Rules for Early Collection of Popular Savings
Expected: Third quarter of 2026
Goal: To update rules for early collection of popular savings, especially those related to tourism-related real estate. The review includes Ordinance SEAE/ME No. 7,660/2022 and Decree No. 70,951/1971.
13. Review of the Sanctions Framework for Fixed-Odds Betting
Expected: Third quarter of 2026
Goal: To improve the current sanctions regime (Ordinance No. 1,233/2024), including penalties for violations, proportionality criteria, and recurrence mechanisms to ensure a fair and well-regulated market.
